Is There A Chance of Canceling Credit Debt if an Elderly Person Has NOT Been Mentally Able to Manage Finances?

If an elderly person has been headed towards alzheimer's, depression, etc. can a credit card company be "liable" for making a loan to an incompetnt person?

  1. it probably would depend on how long this person has been unable to take care of business and how long the credit card debt has been adding up. you would have to check with a doctor to see about the person's mental condition and go from there.
  2. I'm sorry you are having to deal with this. I'm afraid the answer is probably "no", though it is always worth asking! Think about it, even a DEAD person is still responsible for credit card debt if they leave behind any kind of an estate!

I would take a visit to the citizen advice beauro, law center or age concern are normally very good. i was my Mums main carer i had to take over the finances by being made an appointee which is the step before power of attorney but check the legal facts before you take any of the steps above you don't want to get caught up with paying the debt. if the person has Alzheimer's you would be better off trying to go for appointee before she gets too bad because if they deteriorate too far it makes it harder to take control. My mum used to get her own pension but often used to get caught giving it away to anybody she saw. my heart goes out to anyone that has to deal with this chin up
