How do I evict a roommate?
I am the home owner and allowed a "friend" to move in. I also financed his truck because he was unable to obtain credit. The truck is in my name only. The verbal agreement was $147.50 a week. This covered his rent, truck payment, insurance, and cell phone (second line on my account). He also doesn't have a checking account. This is a platonic relationship and I just thought I was helping a guy get back on his feet. They say you don't know someone until you live with them. Boy is that the truth. Turns out my friend has a nasty little drug problem. I have asked for the keys to the truck and for him to leave several times. He flat out told me that if he doesn't have the truck he wont be able to work and if he can't work he will just sit around the house and wont leave until the sherrif's office physically removes him. He owes me over $1600 dollars at this point. Do Ohio landlord/tenant laws apply to roommates? He has a pretty bad temper but has never gotten physical w/me

- Go to the Sheriff's office and get them to evict the guy. They will see to it that you get to keep the truck. Also, better get a restraining order because he is liable to mess up the truck, your property, and you if your not careful. You will have to have proof in small claims court to get the $1600 back. I wish you luck.
- It's your truck and your house. File a TRO. And hand him a 30 day notice for him to beat feet. If he takes off with the car. Report it stolen. Because there is nothing on paper. He has no legal recourse. Because you own the home. You are renting a room to him. That makes him a guest not a roomate. Because he is doing drugs call the police on him. Make sure the cops hand over the keys.

- 1) You have no written lease agreement with this guy, only a verbal agreement, and he is in breach of that. Therefore, as far as you are concerned, he no longer has any form of lease nor you any land-lord obligation. It would be his burden to prove he has a lease, but he cannot do that without a written agreement---so, simple say he has no lease to live here---that's all you have to say---he has no lease to live here---and that's all you say on that matter. 2) You own the truck, the title is in your name only. Do not, repeat, do not let this guy have possession of the truck for any reason. 3) He said he won't leave. It is your house and he has absolutely no right to stay when told to go. 4) You may want to contact an attorney for advice. 5) You could contact the police (sherrif's office)---but keep your statements very brief: 1) I own this house, the deed is in my name. 2) I own that truck, the title is in my name. 3) This man has will not leave---he has no lease---he has a drug problem---and I've ask him to leave and he refuses to leave, unless the police (sheriff) force him to leave. 4) I want to know how to secure a copy of your police report because I intend to use it to aid in my obtaining a court restraining order against this man. - Do you have a signed rental contract? Tell him to move out and that the truck is now yours or obtain a loan in XX amount of time. Change the locks on the door. You can wait until he gets a job and sue him in small claims for the balance due.
